Your A$50 reservation is fully refundable at any time before dispatch.
We refund Total Paid in full, including any shipping you paid, and cover the return postage.
One Discovery Guarantee return per fragrance, per household [1.7(e)]. If your product is faulty, broken or wrong — we always cover everything including return postage [1.10 / 1.11]. Your rights under Australian Consumer Law are never affected.

This document contains our Refund Policy, Privacy Policy, and Terms & Conditions. They should be read together.
Nothing in these policies limits your rights under the Australian Consumer Law. Your statutory rights prevail. Where any term is inconsistent with those rights, your statutory rights prevail.
House Note: Ferruccio Simonello is entering its founding chapter. 01 will be the House's inaugural fragrance. Imagery shown on this site is conceptual and represents the world of the House. Where a meaningful difference occurs between order and dispatch, Clause 1.6 applies.
1. Refund Policy
1.1 Definitions & Overview
For the purposes of this policy:
(a) Total Paid means the total amount paid by you for your order to date as shown at checkout and in your Order Confirmation. Total Paid is the generic term covering all payment types, whether Deposit, Balance, Full Payment, or any other part-payment.
(b) Balance means any remaining amount due to complete your order after a Deposit.
(c) Deposit means a part-payment to secure an allocation.
All payments are processed securely via our payment processor as shown at checkout. Your transaction is protected by your card provider's standard buyer protections in addition to the guarantees below.
All deposits and all payments are fully refundable in accordance with this policy and the Australian Consumer Law.
1.2 Allocation
Our products are offered as a limited allocation. The specific product(s) and allocation size included in your order will be as described at checkout and in your Order Confirmation. Payment of a Deposit secures one (1) allocation as described. All allocations are subject to availability. We reserve the right to limit quantities.
1.3 Payment Types
We may offer one or both of the following at checkout:
(a) Full Payment: Your order is confirmed when payment is successfully processed.
(b) Deposit + Balance: Where offered, a Deposit secures your allocation as described at checkout. The Balance as shown at checkout and in your Order Confirmation is due within 7 days of us notifying you by email that your allocation is ready for dispatch.
If the Balance is not paid within 7 days after that notice, we will send a reminder notice. If the Balance remains unpaid 7 days after the reminder, we may cancel your allocation and refund your Deposit in full to your original payment method.
1.4 Dispatch Guarantee — In-Stock Orders
This clause applies only where a product is described as in-stock at checkout.
(a) Dispatch and delivery timeframes are as shown at checkout.
(b) For Full Payment orders, the dispatch timeframe applies from the date your payment is charged.
(c) For Deposit + Balance orders, the dispatch timeframe applies from the date your Balance is charged.
(d) If dispatch does not occur within 4 weeks of the relevant date above, you are entitled to a full refund of Total Paid on request by emailing studio@ferrucciosimonello.com.
This does not affect your rights under the Australian Consumer Law, including your right to a remedy if we fail to supply within a reasonable time.
1.5 Pre-Launch Orders — No Fixed Timeframe
Some products may be offered prior to final production as a pre-launch allocation. Where a product is described as pre-launch or as a Founding Edition / Founding Custodian allocation:
(a) Any timeframe shown at checkout or on our website for pre-launch orders is an estimate only and may change as we finalise the House.
(b) No fixed dispatch date is promised.
(c) We will notify you by email when your allocation is ready for dispatch, or if there is a meaningful change per Clause 1.6.
(d) You may cancel a pre-launch order at any time before dispatch for a full refund of Total Paid. To cancel, email studio@ferrucciosimonello.com. No fee applies.
(e) This clause does not affect your rights under the Australian Consumer Law, including your right to a remedy if we fail to supply within a reasonable time.
1.6 Material Change
As this is a pre-launch Founding Edition, final refinements may occur between order and dispatch. This clause applies to both in-stock orders (Clause 1.4) and pre-launch orders (Clause 1.5).
If the final product is meaningfully different from the description at the time of your order — including concentration, size, key olfactive profile, or primary materials — we will notify you by email before dispatch with details of the change.
If you are not satisfied with the product as revised, you may elect to receive a full refund of Total Paid by notifying us within 14 days of our notice. If we do not hear from you within 14 days, we will proceed to dispatch the product as revised.
If a meaningful difference under this clause was not notified to you before dispatch, you may elect to receive a full refund of Total Paid by notifying us within 14 days of discovering the difference, provided the 30ml flacon remains sealed and unused. Where the flacon has been opened or used, we may offer a partial refund or store credit at our discretion, except where you are otherwise entitled to a full refund under Clause 1.10 (Your Statutory Rights).
Minor artisanal variations as described in Clause 3.6 are not considered a meaningful difference for the purposes of this clause.
Note: The 14-day timeframe in this clause applies only to our voluntary Material Change guarantee and does not limit your timeframe to claim a remedy for a faulty product under the Australian Consumer Law.
1.7 The Discovery Guarantee
Where your order includes both a discovery vial and a sealed flacon:
(a) Unbox and try the discovery vial first. Keep the flacon sealed until you decide.
(b) If the fragrance is not for you, you may return the unopened, sealed, and undamaged flacon in its original packaging within 30 days of delivery for a full refund of Total Paid including any original shipping costs you paid. This is our promise: you have the right to try before you commit.
(c) This guarantee applies only after Full Payment has been made and the order has been delivered.
(d) Return postage for this voluntary Discovery Guarantee is covered by us. We will provide a prepaid return label or reimburse your reasonable return postage costs on presentation of receipt.
(e) Fair use: Our Discovery Guarantee is limited to one return per fragrance per household. We reserve the right to refuse further voluntary returns under this clause where we reasonably suspect abuse.

Note: The 30-day timeframe in this clause applies only to our voluntary Discovery Guarantee and does not limit your timeframe to claim a remedy for a faulty product under the Australian Consumer Law, which applies for a reasonable time after purchase.
1.8 What Is Not Covered
(a) Flacons that have been opened, used, or damaged are not eligible for return under our Discovery Guarantee (Clause 1.7), except where you have a right under the Australian Consumer Law (Clause 1.10).
(b) Discovery vials provided for trial are not required to be returned and are not refundable as a separate item.
(c) This does not affect your rights under the Australian Consumer Law if the product is faulty or does not meet a consumer guarantee.
1.9 Refund Processing
(a) All approved refunds will be issued promptly and within 5 business days of approval to the original payment method and will equal Total Paid unless otherwise stated in this policy or required by law. The timing of funds appearing in your account depends on your financial institution.
(b) For voluntary returns under Clause 1.7 (The Discovery Guarantee - you tried the vial and did not like the fragrance): We will refund Total Paid including any original shipping you paid. We will cover the reasonable cost of returning the sealed flacon to us — we will provide a prepaid return label or reimburse reasonable postage on proof of receipt. No fee applies.
(c) For faulty products or failure to meet a consumer guarantee under Clause 1.10: We will refund Total Paid including any original shipping you paid. We will cover the reasonable cost of returning the product to us (e.g., we will provide a prepaid label or reimburse reasonable postage on proof of receipt). We will not charge a restocking fee, and original delivery fees are not non-refundable for faulty items.
1.10 Your Statutory Rights & Faulty Products
Nothing in this policy excludes, restricts, or modifies your rights under the Australian Consumer Law. Your rights under the Australian Consumer Law apply in full and cannot be excluded.
(a) You are entitled to a remedy if goods fail to meet a consumer guarantee, including that they are of acceptable quality, match their description, are fit for purpose, and match any sample shown.
(b) For a major failure (including where a reasonable consumer would not have bought the goods had they known of the failure, goods are substantially unfit for purpose and cannot be made fit within a reasonable time, or are unsafe), you are entitled to your choice of replacement or refund, and compensation for any other reasonably foreseeable loss or damage.
(c) For a minor failure that does not amount to a major failure, we may elect to repair or replace the goods within a reasonable time. If we cannot do so, you may elect a refund.
(d) Nothing in Clauses 1.6, 1.7, 1.8, or 3.6 limits these rights.
1.11 How to Claim for a Faulty Product
If you believe your product is faulty, broken, damaged on arrival, or does not match its description:
(a) Email us at studio@ferrucciosimonello.com within a reasonable time with your order number, photos, and a description of the issue.
(b) We will assess your claim and if a consumer guarantee failure is confirmed, we will arrange repair, replacement, or refund as set out in Clause 1.10.
(c) We will arrange and pay for return — we will provide a prepaid return label or reimburse your reasonable return postage costs on presentation of receipt. You do not need to pay return postage for faulty goods.
(d) Refunds for faulty goods will include Total Paid including original shipping, issued under Clause 1.9(c).
2. Privacy Policy
2.1 Information We Collect
(a) Mailing List: When you sign up to receive updates via our website, we collect the contact details you provide, such as your name and email address.
(b) Orders: When you place an order, we or our service providers collect information necessary to fulfil that order, including shipping address, contact phone number, and order details. As described in Clause 2.2, we may also use your email address to send you marketing communications related to your purchase, which you can opt out of at any time.
(c) Payment Details: Payment details are handled directly by our payment processor (as shown at checkout, e.g. Wix Payments / Stripe / PayPal). We do not store your full card details.
(d) Correspondence: When you contact us, including for returns or enquiries, we collect the information you provide.
(e) Browsing: When you browse our website, our platform provider (Wix.com) may automatically collect standard technical information via cookies or similar technology.
2.2 How We Use Your Information
We use your information to provide House updates and priority notifications, manage your mailing list subscription, process payments and refunds, arrange dispatch and delivery, respond to enquiries, and meet legal and accounting obligations. By signing up to our mailing list, or by placing an order with us, you consent to receiving marketing communications from us in accordance with the Spam Act 2003 (Cth). Where your consent arises from placing an order, it is inferred from that existing business relationship and is limited to marketing about goods and services reasonably related to your purchase. Order and account-related communications, such as Order Confirmations, dispatch notices, and Balance reminders, are not marketing and will be sent regardless of your marketing preferences. You can opt out of marketing communications at any time in accordance with Clause 2.6, and this will not affect any order-related communications or your statutory rights. We do not use your information for other purposes without your consent.
2.3 Data Protection & Sharing
Your details remain private. We do not sell, rent, or lease your personal information to third parties. We share limited information only with trusted service providers acting on our behalf, including website hosting (Wix.com), payment processing, and delivery partners. These providers only receive information necessary for their function and are not authorised to use it for their own purposes.
2.4 Overseas Disclosure
Some of our service providers may store data outside Australia, including in the United States, EU, and Israel. Where we disclose information overseas, we take reasonable steps to ensure appropriate protection in accordance with the Australian Privacy Principles.
2.5 Data Retention
We retain your information for as long as necessary to fulfil the purposes described, including legal and accounting obligations. Mailing list details are retained until you unsubscribe or request erasure.
2.6 Your Rights & Control
You have control over your personal information. You may request access, correction, or erasure of your data at any time via studio@ferrucciosimonello.com. Every marketing email we send includes an unsubscribe link, which will be actioned within 5 business days in accordance with the Spam Act 2003 (Cth). You may also unsubscribe from House updates at any time via studio@ferrucciosimonello.com.
2.7 Cookies
Our website uses cookies and similar technologies provided by Wix to ensure functionality, security, and analytics. You can manage cookies via your browser settings.
2.8 Complaints
If you have a concern about how we handled your personal information, contact us first at studio@ferrucciosimonello.com. If not satisfied, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC).
2.9 Changes
We may update this policy from time to time. The current version will always be available on our website. Any changes apply prospectively from the date of update and do not affect how we handle information already collected from you under a prior version of this policy.
3. Terms & Conditions
3.1 Business Details
This website is operated by Ferruccio Simonello ABN 48 548 684 774 as a sole trader trading as Ferruccio Simonello. Contact for all notices: studio@ferrucciosimonello.com
We currently sell only to consumers located in Australia, and these Terms, our Refund Policy, and the Australian Consumer Law are written on that basis. If we offer international shipping in future, additional terms may apply and will be shown at checkout.
3.2 Products and Allocation
(a) Our products are offered as a limited allocation.
(b) The specific product(s) and allocation size included in your order will be as described at checkout and in your Order Confirmation.
(c) All products are subject to availability.
(d) Some products may be offered as pre-launch allocations with no fixed dispatch date as described in Clause 1.5. Where applicable, the product will be clearly identified as a pre-launch allocation at checkout.
3.3 Pricing and Payment
(a) Prices are displayed in AUD and include GST unless stated otherwise.
(b) Payment types and amounts are as shown at checkout, being either Full Payment or a Deposit with a Balance due later as described in Clause 1.3.
(c) Shipping costs, if any, will be shown at checkout.
(d) Your order is not confirmed until payment is successfully processed.
(e) Secure processing via our payment processor as shown at checkout. We do not store full card details.
(f) All deposits and payments are fully refundable in accordance with our Refund Policy, including Clauses 1.4, 1.5, 1.6, and 1.10.
3.4 Orders and Acceptance
An order is an offer to purchase. We accept your offer when we send an Order Confirmation email. We may cancel an order before dispatch where we have reasonable grounds to suspect fraud (such as failed payment verification, a mismatch between billing and shipping details, or a history of disputed charges), or where we are unable to supply. If we cancel your order, we will notify you and provide a full refund of Total Paid. If we cancel due to a pricing error that occurred before Order Confirmation, we will notify you and provide a full refund of Total Paid. After Order Confirmation, we will honour the confirmed price unless required by law. This does not affect your rights under the Australian Consumer Law.
3.5 Shipping
(a) Shipping destinations are as shown at checkout.
(b) Dispatch and delivery timeframes are as set out in our Refund Policy and at checkout, including Clause 1.4 for in-stock orders and Clause 1.5 for pre-launch orders.
(c) Delivery is via tracked courier where available. Title and risk passes to you upon delivery to the address you provide.
(d) For faulty products, see Clauses 1.9(c), 1.10, and 1.11 — we cover reasonable return postage and refund original shipping.
3.6 Product Variation and Refinement
(a) As a small-batch, handmade extrait de parfum, minor variations in colour, scent profile, and fill level may occur due to natural materials and artisanal production. Such variations are not considered defects unless they amount to a major failure under the Australian Consumer Law or cause the goods to fail to meet a consumer guarantee (e.g., not matching description).
(b) Where final refinements result in a meaningful difference as described in Clause 1.6, we will notify you and offer a full refund in accordance with that clause.
3.7 Intellectual Property
All content on this site, including text, designs, logos, images, and the Ferruccio Simonello name and FS device, is owned by Ferruccio Simonello and protected by law. You must not reproduce it without permission.
3.8 Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law, which cannot be excluded. Our products are goods ordinarily acquired for personal or domestic use, so the Australian Consumer Law does not permit us to limit our liability to resupply or refund only. Our liability to you is as set out under the Australian Consumer Law and in Clause 1.10 of our Refund Policy, including your entitlement to compensation for any other reasonably foreseeable loss or damage resulting from a failure to meet a consumer guarantee.
3.9 Consumer Guarantees and Refunds
Your rights under the Australian Consumer Law apply in full. For refunds, please see our Refund Policy which forms part of these Terms. For faulty goods, we cover reasonable return postage and refund original shipping — see Clauses 1.9(c), 1.10, and 1.11.
3.10 Force Majeure
We are not liable for delays or failure to perform due to events outside our reasonable control, including supplier delays, customs clearance, carrier delays, or government action. This clause does not affect your rights under the Australian Consumer Law.
3.11 Governing Law
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.
3.12 Changes
We may update these Terms from time to time. The version at the time of your order applies to that order.
