1. Who we are

This website is operated by Ferruccio Simonello, ABN 48 548 684 774, a sole trader trading as Ferruccio Simonello. Contact for all notices: studio@ferrucciosimonello.com. We currently sell only to consumers located in Australia.

2. Key terms

Order confirmation means the email we send to accept your order.
Total Paid means the amount you paid for your order, as shown at checkout and in your order confirmation.
Flacon means a sealed 30ml bottle of 01 Extrait.
Founding Edition means the first release of 01 Extrait: 200 individually numbered flacons (No. 001 to No. 200). No. 001 is the House flacon and is not for sale.
Founder means the owner of a numbered flacon from the Founding Edition.

3. Products, prices and payment

Our products are offered in limited quantities and are subject to availability. We may limit quantities. Some products may be offered as pre-launch or pre-order items with no fixed dispatch date, as described at checkout. Prices are in AUD and include GST unless stated otherwise. Payment in full is taken at checkout through the payment processor shown there, and we do not store full card details. Delivery within Australia is free. Returns and refunds are governed by our Return and Refund Policy.

4. Numbered flacons

(a) Each Founding Edition flacon is individually numbered. Customer flacons are numbered from No. 002, in the order payments are received.

(b) Your order secures one flacon for each unit ordered, as described at checkout and in your order confirmation.

(c) Once No. 200 is allocated, the numbering closes and no further flacon will carry a Founders number. 01 Extrait may continue to be sold afterwards in unnumbered flacons. The fragrance is the same.

5. Orders and acceptance

An order is an offer to purchase. We accept it when we send an order confirmation, and your order is not confirmed until payment is successfully processed. Before dispatch, we may cancel an order where we reasonably suspect fraud or are unable to supply. If we cancel, we will tell you and give you a full refund of Total Paid.

6. Shipping and delivery

Shipping destinations are as shown at checkout. Dispatch and delivery times are as shown at checkout and in our Return and Refund Policy. Delivery is by tracked courier where available. Title and risk pass to you on delivery to the address you provide.

7. Product variation and refinement

01 Extrait is a small-batch extrait de parfum made with natural materials, so minor variations in the colour of the liquid or the finish of the packaging may occur. These variations are not, by themselves, defects. Where final refinements before dispatch make the product meaningfully different from its description, we will tell you and offer a refund as set out in our Return and Refund Policy.

8. The Founders' Room

(a) Founders. Owning a numbered flacon from the Founding Edition makes you one of The Founders, the inaugural custodians of the House's 200 numbered flacons. Founder status is tied to ownership of a numbered flacon and ends if that ownership ends. Unnumbered flacons do not confer Founder status or access to the Room.

(b) The Room. The Founders' Room is a private, password-protected space recording the custodianship of the 200 numbered flacons, open to verified Founders only. It may in future hold additional content for The Founders.

(c) Access. The Room stays sealed until every numbered flacon sold in the Founding Edition (Nos. 002 to 200) has been delivered and the 30-day return period for the final delivered flacon has ended. Founders will then be invited in.

(d) Listing and privacy. Participation is voluntary. You may be listed by your name, a pseudonym, or flacon number only (for example, Flacon No. 042). If you choose flacon number only, we still hold your name and order details as needed to fulfil your order and meet our legal obligations. This choice controls what other Founders see, not what we hold.

(e) Changes. You may change your listing or withdraw from the Room at any time by emailing studio@ferrucciosimonello.com. We will action your request within 5 business days.

9. Intellectual property

All content on this site, including text, designs, logos, images, the Ferruccio Simonello name and the FS device, is owned by Ferruccio Simonello and protected by law.

10. Liability and consumer guarantees

Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law, which cannot be excluded. For a consumer guarantee failure, you are entitled to the remedies the Australian Consumer Law provides, including repair, replacement, refund and compensation for other reasonably foreseeable loss or damage where applicable. Our Return and Refund Policy explains how to make a claim for a faulty product.

11. Events outside our control

We are not liable for delay or failure to perform caused by events outside our reasonable control, including supplier delays, customs clearance, carrier delays or government action, subject to your rights under the Australian Consumer Law.

12. Governing law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.

13. Changes

We may update these Terms from time to time. The version in force at the time of your order applies to that order.
